King Von and Lil Durk were both charged in the 2019 shooting outside The Varsity in Atlanta
Lil Durk was recently acquitted of five charges connected to a 2019 shooting outside The Varsity in Atlanta. According to multiple reports circulating online, District Attorney Fani Willis says King Von would’ve been indicted if he was still alive, and that his death is the reason the charges were dropped.
“This office has declined to indict Durk Banks, a.k.a. “Lil’ Durk,” for the February 5, 2019 incident because insufficient evidence exists to prove his guilt beyond reasonable doubt at trial. If co-defendant Dayvon Bennett, a.k.a. “King Von,” had not died in 2020, he would have been indicted for this incident,” said Jeff DiSantis, spokesperson to DA Willis.
The statement added, “As stated in the motion declining to indict Mr. Banks, the Atlanta Police Department had evidence to establish probable cause to arrest him. That standard of proof, however, is considerably lower than the “beyond a reasonable doubt” standard of proof at required at trial, which the evidence in this case does not meet.”
