Lil Peep and XXXTentacion Hit with Lawsuit Over “Falling Down”

An artist named Richard Jaden Hoff who formerly went by K.R. i. O is suing the late Lil Peep and XXXTentacion over their 2018 hit “Falling Downn,” TMZ has reported.

In the lawsuit, Richard claims that Peep and XXX sampled his June 2018 Soundcloud track “Under My Breath.” He specifically points out that the guitar riff on his track was looped, sped up, filtered, and equalized but remained significantly similar to the alleged original guitar.  

Columbia Records, Sony Music, and numerous producers of the record have also been named as defendants in the suit. 

The posthumous record was highly successful upon its release and peaked at number 13 on Billboard Hot 100. It was featured on Peep’s sophomore studio album, Come Over When You’re Sober Pt. 2.
